    This Site is for information purposes only, it allows you to learn about the Site Owner's products or services and contact them, among others, by submitting a request for quotation using the contact form. A newsletter may also be available on the Site, the subject of which will be to inform you about the Site Owner's activities, news and new products and services of the Site Owner. The law applicable to the Site and these regulations and agreements concluded on their basis is Polish law.

    The administrator of personal data processed on the Website is the Owner. Personal data is processed for the purposes, within the scope and based on the foundations and principles indicated in the privacy policy published on the Website. The privacy policy primarily contains the principles regarding the processing of personal data by the Administrator on the Website, including the foundations, purposes and scope of personal data processing and the rights of data subjects, as well as information on the use of Cookies and analytical tools on the Website. Using the Website is voluntary. Similarly, providing personal data by the user of the Website is voluntary, subject to the exceptions indicated in the privacy policy (e.g. use of electronic services and statutory obligations of the Owner).

Unlawful activities that may hinder the functioning of the Website are prohibited. Providing content of an illegal nature is also prohibited.     All information and data sent by users via the Website should be reliable and contain true information. It is prohibited to send content that violates the rules of netiquette and contains offensive information that unlawfully violates the Owner's reputation or that may mislead the Owner or other people. The User is prohibited from using the Website to distribute unsolicited commercial information (spam).

    Using the Website is associated with standard threats occurring on the Internet. The basic threat to every Internet user is the possibility of "infecting" the IT system with various types of malware created primarily for the purpose of causing damage or gaining unauthorized access to user data. In order to avoid the risks associated with this, the Owner recommends that each user equip their equipment, which they use to connect to the Internet, with an antivirus program and constantly update it by installing its latest versions, as well as regularly update the web browser and operating system of their end device.

  • ELECTRONIC SERVICES AVAILABLE ON THE WEBSITE

    In addition to the ability to browse information and other content on the Website, the following electronic services are also available: contact form and newsletter.

    1. Contact form

      The contact form allows you to send a contact inquiry to the Owner. Sending an inquiry does not create any obligations on the part of the user or the Owner of the Website, it is only a way to contact the Owner of the Website.

      Using the contact form begins the moment you start filling it out on the Website - it is normally available in the "Contact" tab and/or at the bottom of the Website. The 'Ask for price' form is also available. The contact inquiry is sent upon completion of two consecutive steps – (1) filling out the contact form with the data indicated as mandatory and (2) clicking on the Website after filling out the share field valuation form located under the form – until then it is possible to modify the entered data independently. In the contact form, it is necessary to provide the contact details of the person filling out the form: name and surname, e-mail address, contact telephone number and the content of the message.

      The electronic service of the contact form is provided free of charge and is of a one-time nature and ends when the user sends a contact inquiry via it or when the contact inquiry is stopped via it.

    2. Newsletter

      The subject of the newsletter is to inform about the business conducted by the Owner of the Website, including the products or services of the Owner of the Website, as well as to publish advice and news related to the conducted business.

      Subscription to the newsletter takes place after entering the e-mail address in the tab/newsletter field visible on the Website, to which subsequent editions of the newsletter are to be sent and clicking the action field, and then confirming the desire to subscribe to the newsletter by clicking the link received at the provided e-mail address electronic.

      The Electronic Newsletter Service is provided free of charge for an indefinite period. The Service Recipient has the option, at any time and without giving a reason, to unsubscribe from the newsletter (resign from the newsletter) by sending an appropriate request to the Owner of the Site, in particular via e-mail to the address: info@mesmetric.com or in writing to the address: ul.     Copyright and intellectual property rights to the Site as a whole and the content, graphics, works, designs and signs available within it belong to the Owner or other authorized third parties and are protected by copyright and other provisions of generally applicable law. Use of the content posted on the Site is permitted without restrictions within the scope of personal use. The use of the content posted on the Website in any other scope requires the prior express consent of the Administrator or other authorized third parties.

  • PROVISIONS ON ILLEGAL CONTENT

    Illegal content is information that, in itself or by reference to an activity, including the sale of products or the provision of services, does not comply with the law of the European Union or with the law of any Member State that complies with the law of the European Union, regardless of the specific subject matter or nature of that law (hereinafter referred to as: "Illegal Content").

    The regulation on illegal content is included, among others, in the Services Act - Regulation (EU) 2022/2065 of the European Parliament and of the Council of 19 October 2022 on the single market for digital services and amending Directive 2000/31/EC (Digital Services Act) (OJ L 277, 27.10.2022, p. 1-102) (hereinafter referred to as "Services Act"). "digital").

    This section of the regulations contains provisions resulting from the Digital Services Act in the scope concerning the Website and its Owner. The User of the Website is not generally obliged to provide content when using it. However, the User of the Website may have the possibility to provide content when filling in the contact form or adding a comment on the Website using the tools provided for this purpose by the Owner. In each case of providing content by the User of the Website, he/she is obliged to comply with the principles contained in the regulations.

    CONTACT POINT - The Owner designates the e-mail address info@mesmetric.com as a single point of contact. The contact point enables direct communication between the Owner and the authorities of the Member States, the European Commission and the Digital Services Council and at the same time enables recipients of the service (including those using the Website) direct, fast and friendly communication with the Owner by electronic means, for the purposes of applying the Digital Services Act. The Owner indicates Polish and English for the purposes of communication with its contact point.

    Procedure for reporting Illegal Content and acting pursuant to Article 16 of the Digital Services Act:

    1. Any person or entity may report to the Owner the presence of specific information that the person or entity considers to be Illegal Content at the email address info@mesmetric.com.
    2. The report should be sufficiently precise and adequately substantiated. For this purpose, the Owner allows and facilitates the submission of reports to the above email address containing the following elements: (1) a sufficiently substantiated explanation of the reasons why the person or entity alleges that the reported information constitutes Illegal Content; (2) a clear indication of the exact electronic location of the information, such as the exact URL(s), and, where applicable, additional information enabling the identification of the Illegal Content, as appropriate to the type of content and the specific type of service; (3) the name and email address of the reporting person or entity, except in the case of a report concerning information deemed to be related to one of the offences referred to in Articles 3 to 7 of Directive 2011/93/EU; and (4) a statement confirming the good faith belief of the reporting person or entity that the information and allegations contained therein are accurate and complete.
    3. A report as referred to above shall be deemed to constitute actual knowledge or knowledge for the purposes of Article 6 of the Digital Services Act in relation to the information to which it relates if it enables the Owner, acting with due diligence, to determine, without detailed legal analysis, the illegal nature of the activity or information in question.
    4. Where the report contains the electronic contact details of the reporting person or entity, the Owner shall, without undue delay, send to such person or entity an acknowledgment of receipt of the report. The Owner shall also notify such person or entity without undue delay of its decision with respect to the information to which the report relates, including information on the possibility of appealing the decision.
    5. The Owner shall consider all reports it receives under the mechanism referred to above and shall make decisions with respect to the information to which the report relates in a timely, non-arbitrary, objective and diligent manner. Where the Owner uses automated means for such consideration or decision-making, it shall include information thereon in the notification referred to in the previous paragraph.

    Information on the restrictions that the Owner imposes in connection with the use of the Site, in relation to content provided by users of the Site:

    1. The User of the Site is subject to the following rules in the event of providing any content within the Site:
      • obligation to use the Site, including posting content (e.g. as comments), in accordance with its intended use, these regulations and in a manner consistent with the law and good manners, taking into account respect for the personal rights and copyrights and intellectual property of the Owner and third parties;
      • obligation to enter content that is consistent with the facts and in a manner that is not misleading;
      • prohibition of providing content of an illegal nature, including the prohibition of providing Illegal Content;
      • prohibition of sending unsolicited commercial information (spam) via the Site;
      • prohibition of providing content that violates the generally accepted rules of netiquette, including content containing vulgar or offensive;
      • obligation to have - if necessary - all required rights and permits to provide such content on the Site, in particular copyrights or required licenses, permits and consents for their use, distribution, making available or publication, in particular the right to publish and distribute on the Site (when necessary) and the right to use and distribute the image or personal data in the case of content that includes the image or personal data of third parties.
      • obligation to use the Site in a way that does not pose a threat to the security of the Owner's, the Site's or third parties' IT system.
    2. The Owner reserves the right to moderate content provided by users of the Site. Moderation is carried out in good faith and with due diligence and on the Owner's own initiative or upon receipt of a report in order to detect, identify and remove Illegal Content or other content that does not comply with the regulations or to prevent access to it or to take the necessary measures to comply with the requirements of European Union law and national law in accordance with European Union law, including the requirements set out in the Digital Services Act, or the requirements contained in the regulations.
    3. The moderation process may be carried out manually by a human or based on automated or partially automated tools that help the Owner identify Illegal Content or other content that does not comply with the regulations. After identifying such content, the Owner decides whether to remove or prevent access to the content or otherwise limit its visibility or take other actions it deems necessary (e.g. contact the author to clarify the objections and change the content). The Owner will inform the person who provided the content (if they have their contact details) in a clear and easily understandable manner about their decision, the reasons for it and the available options for appealing against the decision.
    4. In exercising their rights and obligations under the Digital Services Act, the Owner is obliged to act with due diligence, in an objective and proportionate manner and with due regard to the rights and legitimate interests of all parties involved, including the recipients of the service, in particular the rights enshrined in the Charter of Fundamental Rights of the European Union, such as freedom of expression, media freedom and pluralism and other fundamental rights and freedoms.

    Any comments, complaints, appeals or objections regarding decisions or other actions or lack of action taken by the Owner on the basis of the notification received or the Owner's decision taken in accordance with the provisions of these regulations may be submitted in a manner analogous to the complaints procedure indicated above in the regulations in the part concerning the use of the Site. Using this procedure is free of charge and allows complaints to be submitted electronically to the e-mail address provided. The use of the complaint procedure is without prejudice to the right of the person or entity concerned to initiate legal proceedings and does not affect their other rights.

    The Owner shall consider any comments, complaints, claims, appeals or objections regarding decisions or other actions or failure to act on the basis of the notification received or the decision made in a timely, non-discriminatory, objective and non-arbitrary manner. If a complaint or other report contains sufficient grounds for the Owner to consider that its decision not to take action in response to the report is unfounded or that the information complained of is not illegal and does not comply with the Terms of Service, or contains information indicating that the complainant's action does not justify the measure taken, the Owner shall, without undue delay, rescind or amend its decision to remove or disable access to the content or otherwise limit its visibility or take such other action as it deems necessary.

    Persons or entities that have reported Illegal Content and are addressed by the Owner's decisions regarding Illegal Content or content that does not comply with the Terms of Service have the right to choose any out-of-court dispute resolution body certified by the Digital Services Coordinator of a Member State to resolve disputes regarding such decisions, including in relation to complaints that have not been resolved by the Owner's internal complaint handling system.
